1) The words “the Seller” “we”, “us”, “our”, mean World Hobbies.com. The words “customer’ “you”
“purchaser” and “your” refer to registered users, customers, re sellers, associates, the general
public, and visitors to our Website. Any online order from this website is subject to these Terms
and Conditions. We may amend this Agreement at any time at our discretion by posting the
amended terms on our website. Any amendments to this document will be posted in the online
News facility and Welcome page. Except as stated below, all amended terms shall automatically
be effective immediately after they are posted on our Site. This Agreement may not be otherwise
amended other than by a signed written request from you, and a signed acceptance from us.
2) Pre Condition To Use: Do not use this website unless you have read these terms, and accept
that they will govern your right to use and access our website and all documents, links and information
contained on it. If you choose to use World Hobbies’ website ,it’s functions, download from
or otherwise operate our website, then that use shall be deemed as conclusive evidence of your
agreement and acceptance that these terms & conditions govern the rights and obligations between
you and World Hobbies.
3) Ordering and Payment Terms and conditions: World Hobbies will not ship items until funds
are processed and cleared into our transaction account.
Most deliveries will require a “Proof of Delivery” signed receipt and are sent with an "authority to leave" so it is wise to consider this when specifying a delivery address. Note that shipping companies / delivery services usually deliver during normal business hours only.
All subsequent liability for loss / damage is between yourself and the nominated courier and World Hobbies will assume no liability or responsibility for items “not received” once the item has left our warehouse.
Unfortunately we are unable to send to PO boxes as our couriers do not provide for this option.
To ensure transaction security, World Hobbies reserves the right to void transactions or conduct
direct research (by any means at our discretion) to verify the intent and order placed with the
service(s) employed by / through World Hobbies and it’s associates. This may occur from occasionally,
depending on the order size, and or account status or the user. World Hobbies endevours to ensure
all prices are correct for public display / purchase however; should an incorrect price be displayed due to any
unforseen error World Hobbies will seek the balance before delivery should the correct price be greater than that
displayed. If the client purchases goods at a price greater than the correct retail price,
World Hobbies will refund the difference via the original method of payment without any additional cost to the client.
Parental verification of orders - Customers under the age of 18 must have a parent or legal guardian
verify any purchase order. If you do not, it shall be assumed that the user is over the age of 18
years.
4) Links To Other Websites: World Hobbies may provide on our website links to other websites
and information on those websites as a matter of convenience of information. This does not necessarily
imply sponsorship, endorsement, approval or arrangement between ourselves and the owners
of those websites. World Hobbies will assume no responsibility for any of the content found
on any linked website(s). World Hobbies’ website may contain information provided by an outside
party or parties. We accept no responsibility whatsoever for any information or advice provided to
you by its employees or information found on the World Hobbies web site.

5) Limitation On World Hobbies.com.au’s Liability: An essential pre-condition to using our
website is that you agree and accept that World Hobbies is not legally responsible for any loss or
damage you might suffer related to your use of the site, whether from errors or from omissions in
our documents, information, or from any other use of our website. Your use of the site is strictly at
your own risk. World Hobbies accept no responsibility for crash damage and/or loss of kits, engines,
accessories, etc. incurred during operation of a radio-controlled model. In most instances it
is practically impossible to determine whether crash damage was due to radio equipment failure,
operator error , or incorrect installation etc. In addition, no responsibility will be accepted by us, for
any purchased components that are incorporated into radio systems or problems caused by incompatibility
between components, parts, and repairs not conducted by World Hobbies.
6) Trade Practices Act: For the purposes of Sections 68 and 69 of the Trade Practices Act 1974
(Cth). World Hobbies’ liability for any breach of a term of this agreement is limited to:-
The supplying to the buyer of the goods again; or the payment of the costs of having the services
supplied to you again.
7) Express Disclaimers: To the fullest extent permitted by law, World Hobbies completely disclaims
all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability
and / or fitness for any particular purpose. World Hobbies gives no warranty that the
goods and documents will be free from errors, or that any defects will be corrected. Our website
or its server or any “linked website” cannot be guaranteed as free of viruses or any other harmful
components and no responsibility for same will be accepted. World Hobbies does not warrant
or make any representations regarding the use or damages as a result of the use of any goods,
document(s), link or information in its website or as to their correctness, suitability, accuracy, reliability,
or otherwise. It is your sole responsibility and not the responsibility of World Hobbies to
bear any entire costs of servicing, repairs, or correction. Corresponding law in your state or territory
may not permit these exclusions, particularly the exclusions of some implied warranties. Some
of the above may not apply to you.
The products we promote are inherently dangerous. We have no control over the operation, ability
and or experience of the operator, or the conditions under which any purchases from our website
are used. We accept no responsibility for any damage / crash in any way shape or form. It is
standard procedure to ensure any and all equipment is checked thoroughly and is working correctly
via standard safety / operating procedures before each use. The responsibility of the welfare
of any equipment, property, or person(s), is that of the operator and World hobbies shall accept no
liability in this regard.
World Hobbies endeavours to ensure the accuracy of any of the information we publish however,
the documents and graphics published on this site may contain technical inaccuracies or typographical
errors. World Hobbies makes no representations about the suitability of the information
and or graphics presented on this site. All such documents and graphics are provided “as is” without
a guarantee or warranty or of any kind.
8) Whole Agreement: These terms and conditions represent the agreement between you and
World Hobbies pertaining to the use and access to World Hobbies’ website and your use and access
to the documents and information contained therein. No other term(s) shall be included in this
agreement except where it / they are required to be included by any legislation of the Commonwealth
or any State or Territory. All implied terms, except those implied by statute and which cannot
be expressly excluded are hereby expressly excluded.
9) Electronic Communications: When you use our website, or send e-mail correspondence to
us, you are communicating with us electronically. Effectively, you have consented to receive communications
from us electronically. Our communications with our site visitors is by e-mail or by
posting notices on this site. In using our site / contacting us, you agree that all agreements, notices,
disclosures and other communications that we provide to you electronically satisfy any legal
requirement that such communications be in writing.
10) Your Account: If you use this site, you are responsible for maintaining the confidentiality of
your account and password and for restricting access to your computer, and you agree to accept
responsibility for all activities that occur under your account or password. World Hobbies will sell
products individuals under 18 years of age. If you are under 18, you may use the World Hobbies
website only with the involvement / permission of a parent or guardian. Any action of World Hobbies
and / or its affiliates to refuse service, terminate accounts, remove / edit content, or cancel
orders is at our sole discretion; the right to do so is reserved and no correspondence relating to
the execution of these actions shall be entertained.
11) Third Parties Can Not Use Your Information: World Hobbies does not sell or deal in the
trading of personal or customer information. We do however reserve the right to use this in a general
sense without any reference to your name, or personal details to create marketing statistics,
identify user demands and to assist it in meeting customer needs generally. World Hobbies may /
will use the information that you provide us to improve our website and its services. It also may be
required for World Hobbies to disclose information to nominated couriers and or financial institutions.

12) World Hobbies May Disclose: World Hobbies may disclose information in good faith and
where World Hobbies is required to do so:- by law or by any court; to enforce the terms of any of
our customer agreements; or to protect the rights, property or safety of World Hobbies, its customers

13) Jurisdiction: This agreement and this website are subject to the laws of Victoria and the Commonwealth
of Australia. If there is a dispute between you and World Hobbies that results in litigation
then you submit to the jurisdiction of the courts of Victoria. It also may be required for World
Hobbies to disclose information to nominated couriers and or financial institutions. This information
is to ensure the best possible service for the client and each party who obtains this information is
also governed by privacy law relating to the storage or access of personal information. Please also

14) Copyright And Restriction of Use: As a retail customer of World Hobbies you are permitted
to use the documents and download(s) from its website for the purposes of personal usage and
gaining general knowledge. Reproduction of the documents, information or materials contained
within / provided by the World Hobbies website for the purposes of sale or the use by any third
party is not permitted. In particular you are not permitted to republish, upload, transmit electronically
or otherwise distribute any of the documents that you download from the World Hobbies
website. We expressly reserve all copyright of our website and in all documents, images and information
on our website. World Hobbies retains all intellectual property on it’s website except where
otherwise provided.
15) Exclusion of Unenforceable Terms: Where any clause or term above would by any applicable
statute be illegal, void, or unenforceable in any State or Territory, then such a clause shall not
apply in that State or Territory and shall be deemed never to have been included in these terms
and conditions in that State or Territory. Such a clause if legal and enforceable in any other State
or Territory shall continue to be fully enforceable and part of this agreement in those other States
and Territories. The deemed excision of any term pursuant to this paragraph shall not affect or
modify the full enforceability and construction of the other clauses of these terms and conditions.
16) Trademarks and Restriction of Use: It is strictly forbidden to use any trademarks, trade
names, graphics or designs that are on the World Hobbies website. Any unauthorised use of trademarks
/ intellectual property of World Hobbies will result in action being taken against you and / or
any affiliates deemed responsible for any and all infringements.
17) Amendment/Changes to Terms & Conditions: World Hobbies reserves the right to amend
the terms and conditions of use at any time and any changes to said terms and conditions shall
take effect in respect of all subsequent uses by you of the website. It is therefore your responsibility
to check these terms every time before you use the website and only if you accept these terms
should you proceed to access and use any of the functions of the website. World Hobbies shall
reserve the right to refuse access, disable accounts or void any order/transaction performed at our
sole discretion.
18) Voided Transactions: World Hobbies reserves the right to void any transaction that may be
deemed suspect either financially or otherwise and no correspondence regarding voided transaction
shall be entertained. If any financial gratuity has been received for said transaction, any payment
made shall be returned via the original method of payment. Any excess fees in reversing/
voiding payment shall be the purchaser’s responsibility and will be deducted from said payment
prior to any funds transfer by World Hobbies.
19) The customer must understand local laws. World Hobbies make no warranties that products
sold on this website complies with all applicable laws, rules and regulations of the state, territory
or country in which the Customer is situated. The Customer thereby accepts full responsibility
for the importation and use of any products purchased. World Hobbies is not obliged or liable to
repay the purchase price or retake the product in the event the product cannot be used in the state
territory or country in which the customer resides.
20) G.S.T. All prices displayed include the Federal Australian Goods and Services Tax in accordance
with current Australian legislation. In purchasing, the buyer accepts the responsibility of
paying for this tax as well as any other taxes / charges / tariffs incurred or imposed by dispatch
internationally from Australia that may be imposed for the receipt of any goods in accordance with
importation/local law pertaining to the receipt of these goods’ outside of Australia. It is the buyer’s
responsibility to be familiar with the laws regarding importation of goods to any destination prior to
purchase.
21) Delivery Address Accuracy. It is the responsibility of the purchaser to ensure all delivery
information provided to World Hobbies either via a third party or directly to World Hobbies is accurate.
The customer will be liable for any and all excess charges relating to delivery / return caused
by inaccurate information or the inability to receive goods should a signature of receipt be necessary.
22) Currency Converter and other third party tools. Whilst World Hobbies .Com attempts to
ensure all information displayed on it’s website is accurate, World Hobbies . com will not be held
liable for any inaccuracies provided by a third party. ie. The currency converter on this site is used
as a guide only and accurate invoicing information will be given at the final point of sale before the
dispatch of any and all goods ordered.
23) Overseas Orders. Goods ordered for delivery OUTSIDE OF AUSTRALIA’S LEGAL BORDERS
/ BOUNDARIES will be paid for via DIRECT DEPOSIT. These orders will be conducted via
email where freight and final costs inclusive of any applicable Australian Tax Laws pertaining to
such purchases shall be individually calculated and relayed to the purchaser prior to payment.
24) Back Orders/Out Of Stock Items. We accept backorders on the following conditions. All items
including freight are to be prepaid via PayPal or Credit Card (We can not accept payment by direct
debit for Back Orders) . If we have not been able to supply the goods within 60days (2 Calendar Months)
we will, by email, offer to extent your Back Order for another 60 days (with advise on estimate time for
delivery) or alternatively provide a full refund.
If a "Back Order" is not a preferred option, an option to be advised by email when an item is in stock and
can subsequently be purchase via Worldhobbies.com website in the normal manner is available.
